Delhi Consumer Commission Issues Bailable Warrant Against Good Flipping Burgers Official For Non-Compliance Of Order

The District Consumer Disputes Redressal Commission, New Delhi, comprising Poonam Chaudhry (President) and Shekhar Chandra (Member), issued bailable warrants against an official of Good Flipping Burgers for failure to comply with its earlier order directing refund and payment of compensation to the complainant. Brief Facts The complainant, Raminder Kaur, placed online food orders on multiple occasions through the Swiggy platform and was charged ₹25 per order as “packing charges” over and above the displayed price. Contending that such charges were illegal, she approached the Commission. The matter proceeded ex parte as the opposite party failed to appear. Observations & Decision The Commission held that levying separate packing charges amounts to unfair trade practice and deficiency in service. It observed that prices must be inclusive of all components and that packing expenses are to be borne by the seller. Accordingly, the Commission directed refund of ₹75 with interest @ 9% per annum, ₹10,000 as compensation, and ₹5,000 as litigation costs, and restrained the opposite party from levying such charges in future. Execution Proceedings The present order arose in execution proceedings initiated to enforce the above judgment. Despite service of notice, no one appeared on behalf of the judgment debtor and no compliance report was filed. Taking note of the non-compliance, the Commission directed issuance of bailable warrants in the sum of ₹5,000 against the concerned official of the opposite party through the SHO concerned, subject to the complainant furnishing the name and address of the official and filing an affidavit stating that no stay operates against the execution proceedings.
