Failure To Issue Genuine Temporary Registration No., Kupwara District Consumer Commission Holds Fairdeal Motors Liable

The Kupwara District Consumer Disputes Redressal Commission bench comprising Peerzada Qousar Hussain, President and Nyla Yaseen, Member has held Fairdeal Motors liable for indulging in unfair trade practice and putting additional financial burden on the complainant by providing fake temporary Registration No to the vehicle he purchased.Facts of the Case:The complainant purchased a Tata Tiago car from Fairdeal motors and workshop ( Opposite party) by submitting all the documents and required fee for issuance of temporary Registration No. Fairdeal motors issued temporary Registration No. of the vehicle. Consequently, the complainant approached the RTO with the said temporary Registration No. for registration of the vehicle. The said temporary Registration No. later on proved to be fake and not genuine. The complainant then approached the opposite party with the request to issue proper temporary Registration No. of the vehicle but the same was not issued.In the meanwhile, the motor vehicle rules were changed by virtue of which the owner of the vehicle had to pay registration fee @9% of the value of the purchased vehicle. The complainant in accordance with the new rules deposited an amount of Rs.37,878/-. He suffered the loss due to the negligence of the opposite party as they did not issue genuine temporary Registration No. at the time of purchase of the vehicle.Thereafter the complainant approached the opposite party for a refund. The Opposite party failed to pay back the money , feeling aggrieved the complainant issued legal notice. Since there was no reply from the Opposite party, the complainant approached Kupwara district CommissionFairdeal motors failed to appear and contest the case on receipt of notice and it was proceeded Ex-parte .Observation by the CommissionThe commission observed that failure to issue genuine temporary certificate to the buyer and issuing fake temporary Registration No. is violation of the prescribed rules and regulations, which amounts to unfair trade practice.By allowing the appeal, the Commission directed Fair deal to refund the excess amount of Rs.37,878/- deposited by the complainant on account of registration fee. The Commission further directed the opposite party to pay an amount of Rs.1,00,000/- as compensation and Rs.10,000/- as litigation charges.
