Lakshmi Prasanna (Member) allowed a consumer complaint against EZEESHOP18 for delivering reading glasses that did not match their advertised description. Despite promises of intelligent, photochromic, and multifocal lenses, the glasses turned out to be of standard quality.

    Consequently, the Commission found that the seller was liable for deficiency in service and unfair trade practices, directing them to refund the purchase amount of Rs. 1,199/- and pay an additional Rs. 2,000/- as compensation, along with Rs. 2,000/- as costs

    Facts

    Prabhaker Rao (Complainant) ordered reading glasses from EZEESHOP18 (Opposite Party) after seeing their ad on Facebook, paying Rs. 1,199/-. However, when the glasses arrived, they were different from what was advertised. Instead of the promised high-tech (intelligent photo chromic) glasses, the received ones were ordinary plastic reading glasses. Prabhaker tried contacting the seller but received no response. Feeling deceived, he sought compensation through a consumer complaint.

    Observations of the Commission

    The Commission found that the glasses ordered were not what was displayed on the advertisement on Facebook. The Commission also acknowledged that since the glasses didn't match what was described, it indeed caused distress to the complainant. So, they partly allowed the complaint and ordered EZEESHOP18 to refund Rs. 1,199/- for the glasses and pay Rs. 2,000/- as compensation and Rs. 2,000/- as costs. The seller was given 45 days to follow these orders, or they'd have to pay extra interest on the refund amount.
