The District Consumer Disputes Redressal Commission, Shimla, comprising President Dr. Baldev Singh and Member Ms. Nidhi Sharma, held that Reliance Jio Fiber was guilty of deficiency in service and unfair trade practice for failing to restore the complainant's internet connection despite repeated complaints and for failing to produce evidence that the grievance had been resolved.
Brief facts:
The complainant, a consumer of Reliance Jio Fiber services, purchased a six-month Jio Fiber recharge plan for ₹2,824.92 on 2 March 2025 for internet services required for academic and daily use.
However, from 9 April 2025 onwards, the internet connection allegedly remained disrupted despite repeated complaints being lodged with the company.
Although Jio Fiber officials assured the complainant that the issue would be resolved and even inspected the connection, the fault allegedly remained unattended and the promised repair was never completed.
Alleging that Reliance Jio Fiber repeatedly failed to restore the internet connection despite multiple service requests, the complainant approached the District Consumer Commission alleging deficiency in service and unfair trade practice.
The complainant sought restoration of the connection, extension of the service period, ₹1 lakh as compensation for mental harassment and agony, and ₹25,000 towards litigation costs.
In its defence, Jio Fiber contended that the complainant had repeatedly cancelled the service requests before they could be resolved and claimed that the issue had already been rectified.
Observation and decision:
The Commission observed that while it was undisputed that the complainant's Jio Fiber services had been disrupted, the opposite party failed to produce any technical evidence or affidavit from the engineer who allegedly attended the complaint to prove that the issue had been resolved.
It held that the complainant's evidence remained unrebutted and established deficiency in service and unfair trade practice on the part of Jio Fiber.
Accordingly, the Commission allowed the complaint and directed Reliance Jio Fiber to restore the complainant's internet connection free of cost. It also awarded ₹10,000 as lump sum compensation towards mental harassment, agony and litigation expenses, to be paid within 45 days of receipt of the order.
