    The Ministry of Housing and Urban Affairs (MOHUA) has released the implementation status report of the Real Estate (Regulation & Development) Act, 2016, commonly known as RERA, in India. This legislation, which came into effect on May 1, 2017, aims to protect homebuyers and promote investments in the real estate industry by establishing a Real Estate Regulatory Authority (RERA) in each state for the regulation of the real estate sector and acting as an adjudicating body for speedy dispute resolution.

    Summary of the Report

    All states/UTs have notified rules under RERA, except Nagaland, which is in the process of notification.

    32 states/UTs have established Real Estate Regulatory Authorities (27 permanent, 5 interim). Ladakh, Meghalaya, Nagaland, and Sikkim are yet to establish their authorities.

    28 states/UTs have set up Real Estate Appellate Tribunals (24 permanent, 4 interim). Several states, including Arunachal Pradesh, Jammu & Kashmir, and West Bengal, are yet to establish these tribunals.

    Regulatory authorities in 30 states/UTs have operationalized websites under RERA, with Arunachal Pradesh and Manipur pending.

    Adjudicating officers have been appointed in 26 states/UTs, while 10 regions, including Arunachal Pradesh, Bihar, and Uttarakhand, are yet to make appointments.

    Across the country, 122,553 real estate projects and 86,262 real estate agents have registered under RERA.

    A total of 120,605 complaints have been disposed of by the Real Estate Regulatory Authorities nationwide.

    Among states, Maharashtra, Tamil Nadu, Gujarat, Telangana, and Karnataka are the top five states with the most RERA registered projects. There are 44,318, 21,045, 12,972, 8,227, and 6,582 projects respectively in these states. Puducherry stands out as the top union territory with 222 registered projects, while Dadra & Nagar Haveli and Daman & Diu together account for 208 registered projects.

    The top five states with the highest number of disposed cases under the Real Estate (Regulation & Development) Act are Uttar Pradesh (45,221), Haryana (20,604), Maharashtra (16,323), Madhya Pradesh (5,800), and Gujarat (5,702). Additionally, Dadra & Nagar Haveli and Daman & Diu lead among union territories with 907 disposed cases, followed by the National Capital Territory of Delhi with 555 cases.

    In Conclusion, the 2024 implementation report highlight significant progress in RERA implementation, with increased registration of projects and agents, disposal of complaints, and establishment of regulatory mechanisms nationwide.
