    The District Consumer Disputes Redressal Commission, Rewari (Haryana) bench comprising Sanjay Kumar Khanduja (President) and Rajender Parshad (Member) held Vishal Mega Mart liable for deficiency of service for failure to return a couple of trousers after providing an assurance and a credit note to their customer. Vishal Mega Mart and its officials neither returned the trousers nor refunded the price of both the trousers.

    Brief Facts:

    Dinesh Kumar (“Complainant”) purchased two trousers and one coat from Vishal Mega Mart (“Store”) on 11.11.2022. After the purchase, he found that he did not like the colour of one of the trousers. He went back to the store to exchange it for a different pair of trousers. However, the store officials insisted that they’d change both the trousers. The complainant agreed to this and deposited the second trouser, receiving a credit note on 12.11.2023. However, the store failed to return the trousers or refund the money for either of them. Subsequently, the complainant sent a legal notice to the store, but the notice remained unanswered. As a result, the complainant filed a consumer complaint in the District Consumer Disputes Redressal Commission, Rewari, Haryana (“District Commission”).

    The Complainant contended that he was dissatisfied with the colour of one of the trousers and attempted to exchange it for a different pair of trousers. He argued that the store officials insisted on him returning both trousers instead of just the one he was dissatisfied with. He further claimed that he followed their instructions, deposited the second trouser, and received a credit note. He argued that the store and its officials failed to refund the money for the trousers and did not return the trousers themselves.

    On the other hand, the store and its officials did not contest the complaint, and they did not appear during the proceedings. They did not provide any counter-arguments or explanations for their actions in response to the complainant's contentions.

    Observations by the Commission:

    In light of the presented evidence and the lack of response from the Opposite Parties during the proceedings, the Commission found substantial merit in the complainant's case. The District Commission ordered Vishal Mega Mart to return Rs. 849, representing the value of the trousers to the complainant. Furthermore, it was instructed to provide a compensation amount of Rs. 10,000 to address the mental agony and harassment experienced by the complainant due to the deficient services. In addition, the District Commission directed the store to reimburse the complainant with Rs. 11,000 as litigation expenses.
