The West Bengal Real Estate Regulatory Authority (WBRERA) has issued an office order addressing the mandatory display of registration details and website addresses in advertisements and other promotional material of registered projects by builders.

The order emphasizes the requirements stipulated under Section 11(2) of the Real Estate (Regulation and Development) Act, 2016, which mandates builders to prominently display the WBRERA Registration Number and website address in all project-related advertisements and prospectuses.

Additionally, the order mentions that it has been observed that some builders are neglecting this provision, either by omitting the WBRERA Registration Number and website address altogether or by displaying them in a manner that is not easily readable, such as using small font sizes or displaying details vertically.

In response to these violations, the WBRERA, under the authority granted by Section 37 of the Act, has issued the following directives:

    1. All advertisements and publicities related to WBRERA registered projects, across various media including print, electronic, and social media platforms, must prominently display the WBRERA Registration Number details.

    2. Builders must display the Project Registration Number and WBRERA Website Address in the right top corner/quadrant of the advertisement or prospectus, with font sizes not less than one-third of the size used for the project name.

    3. The RERA Registered information should cover a minimum of 20% of the space used in print media advertisements.

    4. The colour and size of the displayed Project Registration Number and Website Address must ensure easy visibility to the public.

    5. For advertisements on FM radio, electronic media, and social media platforms like WhatsApp, the Project Registration Number and Website Address must be prominently mentioned.

    6. The WBRERA Registration Number and Website Address must also be displayed on the project site's display board.

    7. All advertisements and publicities related to WBRERA registered projects must be uploaded in the quarterly uploading section of the WBRERA web portal.

    8. Failure to comply with these directives may result in penal actions, including penalties of up to 5% of the estimated project cost.

In conclusion, the office order issued by West Bengal RERA mandates the clear display of registration details in real estate advertisements and promotional materials. This directive aims to ensure transparency and accountability in the real estate sector by enforcing advertising standards for registered projects.
