Don’t File Frivolous Matters, SC Tells State Of Uttar Pradesh [Read Order]

We see a number of cases are coming, particularly from the state of UP, which are not even worth contesting, the bench observed.While dismissing a special leave petition filed by the State of Uttar Pradesh, the Supreme Court directed the Chief Secretary to issue appropriate directions to its Law Department for not filing frivolous matters before the apex court.The state had approached the apex court against an order of Allahabad High Court directing it to release the entire amount of post-retiral benefits to which the retired employee is entitled, including pensionary benefits, as well as the amount which has been allegedly deducted from his GPF.The bench headed by Justice Arun Mishra, which heard the plea, observed: “Law Department of the State should understand that in which matters petitions are required to be preferred in this Court. We see a number of cases are coming, particularly from the state of U.P., which are not even worth contesting.”The bench also directed the Chief Secretary of the State to apprise it about the guidelines and what steps they are taking to prevent filing of a frivolous case like the instant one. The court also directed him to submit an action-taken report on July 16, 2018.Yesterday, a bench headed by Justice RK Agrawal had asked the State of Chhattisgarh not to force government employees to approach court claiming gratuity. The bench had also imposed the cost of Rs. 25,000 on the state for dragging the litigation. Another bench headed by Justice Madan B Lokur, while allowing an appeal preferred by the Union of India against a high court order that had favoured a retired railway employee, recommended the Department of Personnel and Training of the Government of India to try and make life after retirement easier for a government servant.Read the Order Here
