Attempt-To-Murder Accused Gets Short-Term Bail From Allahabad High Court To Take UP Home Guard Physical Test

The Allahabad High Court (Lucknow Bench) on Monday granted short-term bail to an attempt to murder accused lodged in jail to enable him to appear for the UP Homeguard recruitment physical test.
The Court directed that he be released from jail at 4:30 AM and remain in police custody throughout the period.
A bench of Justice Rajeev Bharti passed the order in a short-term bail application moved by Anuj Kumar Tiwari @ Golu, who is in custody at District Jail, Raebareli since May 10, 2026.
Tiwari sought short-term bail to participate in the physical test scheduled for 7:00 AM on September 16, 2026 at Sports College, Nevlapur (Kodai Ghat), Joniyakalan, Fatehpur, Uttar Pradesh.
The State opposed the application by pointing out that the applicant was facing serious charges including attempt to murder, rioting, criminal intimidation, etc. However, it did not dispute the facts placed before the Court regarding the applicant's physical test.
Considering the circumstances, the High Court directed that the applicant be released on short-term bail on September 16 at 4:30 AM till 6:00 PM in police custody.
The Court specifically directed that the applicant be released in the custody of two police constables, who would escort him throughout the period of short-term bail.
The Court directed the Superintendent of Police, Raebareli, to release the applicant from jail at 4:30 AM on September 16 in the aforesaid police custody.
The SP was further directed to ensure that the applicant's custody was handed over to the Superintendent of Jail, Raebareli, by 6:00 PM the same day.
The High Court directed the concerned authorities to comply with these directions in letter and spirit. The SP was also directed to depute two police personnel to accompany the applicant.
The Court ordered that they "shall keep a watch on the activities of the applicant" during the period during which he is permitted to attend the UP Homeguard recruitment physical test. The short-term bail application was accordingly disposed of.
