'Vague Averments': Allahabad High Court Refuses To Entertain PIL Alleging 'Arbitrary' Removal Of Ali Khamenei Portraits By UP Police

The Allahabad High Court (Lucknow Bench) on Tuesday refused to entertain a Public Interest Litigation (PIL) petition filed by a body of Shia scholars challenging the alleged 'arbitrary' police action of removing portraits of recognized Iranian leaders.
The PIL petition was filed by Majlis Ulema-E-Hind, through its General Secretary, Maulana Syed Kalbe Jawad Naqvi, seeking to restrain the Uttar Pradesh Police from interfering with the display of portraits of leaders, including Ayatollah Seyyed Ali Khamenei and Ayatollah Seyyed Ali Al-Sistani.
The bench of Justice Rajan Roy and Justice Manjive Shukla, however, denied the relief sought, noting that the PIL plea contained "general and vague" allegations against the police machinery.
The petition, filed through the organisation's General Secretary, Maulana Syed Kalbe Jawad Naqvi, sought a writ of mandamus to direct all district police heads and Station House Officers (SHOs) across Uttar Pradesh to “cease and desist from taking any coercive action" against individuals peacefully displaying portraits of spiritual leaders or participating in religious mourning assemblies.
The petitioner specifically requested that the Court restrain the police from dismantling or seeking the removal of banners, portraits, or other visual representations of leaders such as Ayatollah Seyyed Ali Khamenei and Ayatollah Seyyed Ali Al-Sistani when displayed lawfully on private residential or commercial properties.
Additionally, the plea sought a directive to the respondents to decide on the representation letters served on June 12, 2026.
Considering the averments in the petition, the bench observed that the petitioner had made only "general and vague averments regarding police interference and removal of posters of certain religious leaders of Iran, who are dear to the Shia community".
It also noted that no specific instance had been provided regarding any house or premises where the poster may have been pasted, installed, or removed, nor was there any demonstration of how such alleged removals were conducted.
The Court further clarified that if there is any specific cause of action against any such police person under any provision of law, the remedy prescribed in this regard can be availed.
The Court stated that it saw "no reason to consider such an omnibus prayer based on such averments" and accordingly, it disposed of the writ petition.
The PIL petition was filed through Advocate Mohd Kumail Haider.
