No Specific Community Named: Allahabad High Court Grants Bail In Case Over Alleged 'I Love Mohammed' Post

The Allahabad High Court recently granted bail to a man booked for allegedly posting on his Instagram handle that he could get his head severed and could sever heads for 'I Love Mohammed'.A bench of Justice Rajiv Lochan Shukla observed that the 'supposed objectionable' post made by the applicant does not name any particular caste or community.Accused-Nadeem, a resident of Muzaffar Nagar District, was booked by UP Police last year under Sections 353(2), 192, and 152 BNS for allegedly making sensitive remarks on his Instagram profile. Seeking bail, his counsel argued in HC that a charge sheet has now also been submitted and there is no likelihood of the trial being concluded in the near future. He also submitted that the applicant has no criminal antecedents.On the other hand, opposing the bail prayer, the Additional Government Advocate for the State argued that he had posted an insensitive comment, stating: "I Love Mohammed के लिए गर्दन कटवा भी सकते हैं और काट भी सकते हैं" (For 'I Love Mohammed', we can have our heads severed and can sever heads too).It was strongly contended that such an objectionable slogan had led to widespread riots in the District of Bareilly, resulting in serious property damage. It was further contended that law and order situation became dismal due to anti-social elements who were incited by these kinds of slogan. The AGA, however, did not deny that the said case related to District Bareilly, and that the accused Nadeem Khan mentioned therein is not the applicant.Against this backdrop, taking into account the material collected during the investigation, the role assigned to the applicant as well as the fact that the applicant has been in jail since October 7, 2025 and has no criminal antecedents, the Court deemed it appropriate to enlarge him on bail.Case title - Nadeem vs State Of U.P.
