The Allahabad High Court on Tuesday dismissed a criminal writ petition filed by a man who sought registration of an FIR against the persons who are involved in the alleged Sex Racket running in Kanpur Nagar.

Though the petitioner initially raised concern over the uploading of indecent videos of his wife and daughter online, in later hearings, he eventually made scurrilous allegations against his family members by imputing immoralities to them.

Taking a strong exception to the same, a bench of Justice JJ Munir and Justice Vinai Kumar Dwivedi strongly slammed the petitioner as it noted that his claims against his own wife and daughter were a "bundle of falsehood".

The Court also observed that the petitioner suffered from the "holier-than-thou syndrome" and that thinks himself to be a "crusader against all immoralities in society".

The High Court noted that this petition was actually about a family dispute and his act of bringing in the allegations of a sex racket against own family was the "most abominable" way of placing a family cause before the Court.

It may be noted that, to ascertain the authenticity of multiple video files in digital format and the screenshot images supplied by the petitioner, the police handed them over to the C3iHub at the Indian Institute of Technology, Kanpur.

However, IIT Kanpur's report revealed that the faces in the provided image and those appearing in the recovered videos did not match.

The forensic analysis further indicated that the recovered media files were approximately 10-12 years old. The report noted that "the available digital evidence supports the conclusion of incorrect or misleading identity association".

Taking note of the report, the bench specifically remarked thus:

"The aforesaid report of the IIT, Kanpur persuades us to believe that the wild allegations that the petitioner has come up with against his family of being involved in sex rackets etc., and shown on websites are a bundle of falsehood"

During the hearing, while the court attempted to reunite the family by sending them to the HC mediation and Conciliation Centre, the mediators submitted a report stating that the family are not in a position to reconcile their differences.

Importantly, the bench noted that the petitioner was constantly ridden with an ego of his own and that his wild allegations against his family of being involved in sex rackets were scandalous, with some fit to be expunged.

Thus, concluding that there is no basis to issue a mandamus to the police to enquire into any kind of sex racket on the basis of hollow allegations, the petition was dismissed.
