'In 21st Century, When India Is In Process Of Mars Landing...': Allahabad HC Censures Consolidation Director For Passing 'Illegible' Handwritten Order

“The Court is amazed that Deputy Director of Consolidation, Jaunpur, in the 21st century, when Bharat is in process of ‘Mars Landing’, has passed a short-impugned order in his handwriting which is absolutely illegible, when there are other options available such as by using computer or voice typing, however, the Officer has not used it,” the bench of Justice Saurabh Shyam Shamshery remarked.

In view of this, the Court directed the Deputy Director of Consolidation, Jaunpur to pass an order “which shall be legible either in clear hand writing or by computer typing”.

The Court was essentially dealing with a writ plea filed by one Shamsuddin challenging the order of the officer concerned. However, when the Court sought to know the contents thereof, it failed to get any specific response from the counsels appearing for the rival parties.

Consequently, the court directed the officer concerned to pass a legible order within a period of three weeks and provide a certified copy of the same to the petitioner thereafter free of cost.

With this, the matter was posted for hearing after 6 months. A copy of the order was also directed to be sent to the Consolidation Commissioner, Lucknow, Uttar Pradesh as well as to Deputy Director of Consolidation, Jaunpur.
