Lucknow PUBG-Murder Case| Allahabad High Court Grants Bail To Juvenile Accused Of Killing Mother

In the infamous Lucknow PUBG-Murder case, the Allahabad High Court last week granted bail to the 16-year-old boy (at the time of the incident) who has been accused of killing his own mother using his father’s licensed pistol. Though initially it was claimed that the Boy killed his mother as she stopped him from playing PUBG, a mobile-based game, the subsequent news reports suggest that the Juvenile admitted that he killed his mother as he was irritated with the frequent visits of a property dealer to his house to meet his mother. The FIR in this case was lodged against him by his grandmother alleging that he killed his mother after she restrained him from using mobile phones. The bench of Justice Shree Prakash Singh reasoned that he is a juvenile and that there is no eye witness to the said incident “…admittedly, the revisionist was 16 years 8 months and 7 days at the date of the incident and that is evident from the impugned order of the Juvenile Justice Board. Thus, it is established that the revisionist is a juvenile.” The Court also noted that the report filed by the DPO (Deputy Probation Officer) does not disclose the fact that the release of the revisionist shall bring him in association with any unknown criminal or expose the revisionist to moral, physical or psychological danger. The Court passed this order while hearing a revision plea moved by the juvenile challenging the order of the Additional District & Sessions Judge, POCSO Court, Lucknow, denying him bail under Section 302 IPC. Before the High Court, the Juvenile’s father undertook that he will take care of the conduct and behaviour of the revisionist and further added that the Juvenile will observe good conduct and behaviour behave in future. In view of this, the Court granted him bail by observing this: “It has also been considered that the revisionist is in a child protection home since 08.06.2022 and it has been undertaken by the father of the revisionist who is the guardian that he will keep vision over the revisionist and the revisionist will observe good conduct and behaviour.” Appearances Counsel for Revisionist: Pradeep Kumar Rai, Prakash Pandey, Praveen Kumar Shukla Counsel for Opposite Party: G.A.
