Allahabad High Court Grants Interim Relief To Reliance Bio Energy In Complaint Under Air Quality Management Act

The Allahabad High Court has granted interim relief to Reliance Bio Energy in complaint case filed under Commission for Air Quality Management in NCR & Adjoining Areas Act, 2021.
Reliance Bio Energy is a subsidiary of Reliance Industries Ltd, in the process of establishing Compressed Biogas plant across India by utilizing agricultural waste (Parali).
The director had been summoned under Section 14(2) of the Act in connection with a unit at Village Chitauli, Rampur, District-Hapur, following an an by a flying squad.
The company submitted that a penalty of Rs. 2,70,000/- was imposed on them, which was deposited in the account of the UP Pollution Control Board and thereafter, it was permitted to run the unit subject to strict compliance of the directions issued from time to time.
Subsequently however, the instant complaint was filed by the Assistant Environmental Engineer of Regional Office, U.P. Pollution Control Board (UPPCB), Ghaziabad with a 'malicious intent'.
Noting that the matter requires consideration and issuing notice to the opposite party, Justice Deepak Verma observed,
“Till the next date of listing, further proceedings against the applicant in Complaint Case No.5087 of 2025 (State of U.P. vs. Reliance Bio Energy Pvt. Limited), under Section 14(2) of Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021, Police Station Hafizpur, District Hapur, shall remain stayed.”
