A bench of Justice Arun Kumar Singh Deshwal passed the order after reviewing the nature of the filthy messages and social media posts made by the applicant.

"On perusal of the messages and social media post sent by the applicant, this Court found that the applicant is not a person of sound mind; therefore, the C.M.O., Kaushambi is directed to conduct his mental examination and keep it on record of the file of this case before the concerned district court”, the High Court ordered.

The Court was hearing a bail application filed by the accused-applicant (Rahul Kumar Saroj) in a case registered under Sections 64(1), 74, 351(2), 352, and 333 BNS and Sections 3/4 of the POCSO Act, and Section 66E of the IT Act.

According to the prosecution's case, the victim had earlier lodged an FIR alleging that the applicant somehow obtained her obscene photographs by hacking her mobile phone and thereafter, he started blackmailing her and also threatened her on social media.

The police arrested the applicant in that case. However, upon being released on bail, he allegedly resumed threatening the victim.

The victim stated in her statements recorded under Sections 180 and 183 of the B.N.S.S. that despite their prior relationship, the applicant used her obscene videos and photographs to blackmail her, demanding Rs. 5 lakhs by posting messages on Instagram and sending direct messages.

Seeking bail, the applicant's counsel argued that he had been in a relationship with the victim and was falsely implicated after he refused to marry her.

Opposing the plea, the State and the informant's counsel produced in court the messages sent by the applicant to the victim and her relatives, as well as the photographs of the victim posted on social media.

Taking into account the messages and the images, the bench observed that on the basis of the obscene photographs and videos, the applicant was blackmailing the victim and sent "filthy and obscene messages not only to the victim but also posted several photographs and videos on social media".

“Considering the language and nature of messages and the nature of photographs and video posted by the applicant on social media, this Court is not inclined to release the applicant on bail”, Justice Deshwal observed.

Hence, rejecting his bail plea, the Court directed that he must be medically examined.
