The Allahabad High Court has observed that private CCTV cameras cannot be installed or positioned in a manner that interferes with a neighbour's privacy.

A Bench of Justice Ajit Kumar and Justice Garima Prashad made the observation while disposing of a writ petition filed by one Yogendra Maurya, who was aggrieved by the positioning of a CCTV camera by his neighbour.

It was his case that the neighbour had positioned the CCTV camera in a way which exposed the entry and exit from the petitioner's house and this interfered with the privacy of people visiting or leaving the premises.

The petitioner had contended that this positioning of the camera violated his privacy.

"In our considered view, no private CCTV camera can be installed and positioned in such a manner as to interfere with the privacy of a neighbour", the Court observed.

However, instead of issuing a direction concerning the camera's removal or repositioning, the High Court disposed of the petition with a direction to the petitioner to file an application before the District Magistrate concerned.

The Court directed that, in the event, the petitioner files such an application, the District Magistrate concerned shall consider and decide the same within a period of one month

The petition was accordingly disposed of.
