    Dealing with two contempt petitions filed by Radhasoami Satsang Sabha against Agra District Administration's demolition action over Satsang Sabha-owned land, the Allahabad High Court, on Friday, directed the Standing Counsel to seek instructions in the matter within a month.

    Posting the matter for further hearing on December 8, a bench of Justice Rohit Ranjan Agarwal directed the Applicant (Satsang sabha) to serve a copy of the contempt application upon Standing Counsel IB Singh within 48 hours.

    Essentially, Radhasoami Satsang Sabha is a Religious and Charitable Society with its headquarters at Dayalbagh, Agra owning land admeasuring 1500 acres in Sikanderpur, Khaspur, Jaganpur and Ghatwasan villages, Tehsil and District Agra out of which, about 1200 Acres is agricultural land.

    In the application filed before the High Court, the Satsang Sabha stated that it had agreed with the then Government of United Provinces in 1935 to provide water to the agricultural lands of the petitioner for irrigation purposes. A Nahar/canal was constructed which ran from river Yamuna on the southern side for 3.5 Km. with maintenance track on either side in its lands in Khasra Numbers 3, 326, 330 and 364 in Jaganpur and 205 in Sikanderpur and also through its lands in village Khaspur. For 85 years, the possession and use of land remained undisputed.

    It has been alleged that due to pressure from land mafias, the District Administration, Agra illegally constructed a road over certain parts of Applicant’s land. After that, in 2020, an illegal attempt to survey the petitioner's property without any prior notice.

    Subsequently, in 2021, respondent authorities illegally demolished the wall erected on the Southern boundary of the Western side maintenance track of the Nahar in Khasra Number 330 of Jaganpur without any prior notice. Against this action, the applicant had approached the High Court. However, before the petition could be heard, the authorities demolished the remaining portion of the wall.

    On a mention made of the writ petition, the High Court passed an order of status quo, which is in operation till date. Another writ petition was filed in 2023 for Khasra No. 205, Sikandarpur, Tehsil Sadar, District Agra, in which the High Court granted the order of status quo.

    However, the District Administration, on the early morning of 23.09.2023, demolished the wall and gate of the properties of the Applicant, including the properties on which the order of status quo had already been passed by the High Court.

    Accordingly, the contempt application was filed against the District Magistrate and the various officers of the District Administration who were involved in the alleged illegal demolition of the boundary wall and gate on the properties of Radhasoami Satsang Sabha in Dayalbagh.
