In a scathing observation, the Allahabad High Court has said that it is a well-known fact throughout the State of Uttar Pradesh that students are suffering due to the non-availability of Principals and Assistant Teachers. A bench of Justice Prakash Padia made this observation while hearing a writ petition filed by a junior high school, which moved the HC aggrieved by the teaching and non-teaching staff's non-appointments according to the sanctioned posts. As per the petition, the positions of one Headmaster, two Assistant Teachers, one Clerk, and two Class-IV employees in the school have been vacant since June 2022. The Court noted that, despite several meetings between state government officials, no decision has been reached so far. In fact, in the previous hearings, the High Court pointed out the ambiguity regarding the timeline for appointing headmasters and teachers. On December 10, 2024, the Court specifically observed that due to the large number of vacancies, the state's education quality is being compromised, and no progress has been made in addressing the issue. During the hearing on Friday, the court was informed that despite letters sent by the state government to the Director General of Schools, Education, UP, requesting a clear report or proposal, no such proposal had been forwarded to date. Taking note of the same, the single judge on Friday directed the Director General of School Education in Uttar Pradesh to file his personal affidavit within ten days regarding his delay in submitting his report to the state government. “It is well known fact throughout the State of U.P. that the students are suffering due to non-availability of Principals and Assistant Teachers. In so far as present case is concerned, it is clear that inpsite of the repeated request made by the institution till date the necessary orders were not passed by the authorities to fill up the posts of Principal and Assistant Teacher. The right to education is a fundamental right, and from perusal of the facts as narrated above, it is clear that the respondents are violating the fundamental rights guaranteed to the citizens under the Constitution of India,” the court remarked as it posted the matter for hearing next on February 17.Case title - C/M Krishi Audyogik Vidyalaya Aau And Another vs. State Of U.P.
