    In a significant move, the Allahabad High Court last week directed the registration of a suo motu Public Interest Litigation to explore the framing of a comprehensive insurance scheme for practising lawyers across the State of Uttar Pradesh.

    This comes after the Court noted multiple instances of advocates facing severe monetary difficulty while undergoing medical treatment for serious, life-threatening emergencies.

    A bench of Justice Rajan Roy and Justice Manjive Shukla passed the order while hearing a 2024 PIL plea filed by a practising HC advocate (Hari Prasad Gupta) concerning a State Law Officer (Neeraj Chaurasia) who had met with a serious road accident but was unable to meet the expenses for medical treatment.

    In the same manner, another application was filed on April 2, 2026, apprising the bench about the medical condition of another practising advocate (Sudhir Chaudhary) who is undergoing treatment for a brain haemorrhage but is unable to pursue his medical treatment on account of financial constraints.

    Taking immediate note of the medical emergency, the bench referred to its earlier order of May 30, 2024, wherein the state government was directed to consider framing an insurance scheme for the lawyers appearing for the State Government throughout the State of UP.

    Observing the recurring nature of such acute financial hardships faced by the lawyers, the bench has now directed that a separate Public Interest Litigation be registered as 'In Re-Suo Motu Insurance Scheme etc for Lawyers in the State of U.P.'.

    The division bench directed that the Oudh Bar Association through its Secretary, the Bar Council of Uttar Pradesh through its Secretary and the Principal Secretary (Law) or Legal Remembrancer of UP shall be impleaded as opposite parties in the newly registered suo motu petition.

    The bench also directed the Secretary of the Oudh Bar Association to consider the urgent request of Sudhir Kumar Chaudhary for the release of funds for his medical treatment in accordance with the prevailing practice and rules.

    The matter will come up for a hearing this week.
