'Indian State' Remark | Plea In Allahabad HC Challenges Sambhal Court Order Refusing FIR Against LoP Rahul Gandhi

A petition has been moved in the Allahabad High Court under Article 227 of the Constitution of India, challenging a Sambhal Court's order that rejected an application seeking the registration of an FIR against the Leader of the Opposition in the Lok Sabha, Rahul Gandhi, over his alleged controversial remarks.
The petition, filed by Simran Gupta of the Hindu Shakti Dal, contends that Gandhi's remarks have hurt public sentiments across the country. The controversy pertains to the statement allegedly made during the inauguration of the AICC office in 2025, where he reportedly stated: "We are now fighting the BJP, the RSS, and the Indian State itself."
Last year, a Sambhal Court initially rejected the petition seeking registration of an FIR. A subsequent revision plea filed against the said order was also dismissed. Therefore, the applicant has now moved to the High Court.
On Wednesday, the matter came up before a bench of Justice Samit Gopal, where AGA Rupak Chaubey submitted that the petition had failed to disclose the grounds of challenge to the impugned orders.
Pursuant to this, Advocate Rohit Nandan Pandey, the counsel for the petitioner, sought two weeks' time to file a supplementary document disclosing the grounds of the challenge.
Allowing the prayer, the bench directed that if any such supplementary affidavit is filed, the office shall restore the same and place it on record by the next date.
The matter will now come up for a hearing next on March 11.
It may be noted that a Court in Lucknow last year directed the registration of a complaint case against Gandhi on an advocate's complaint objecting to this very alleged remark. More details here
The plea, filed by Advocate Nripendra Pandey, contended that Gandhi's alleged remark amounts to a seditious and anti-national statement made deliberately with the intent to destabilise the country.
