Calcutta High Court Permits Ex-TMC Leader & MLA Humayun Kabir To Approach Ministry Of Home Affairs For Z+ Security

The Calcutta High Court permitted Bharatpur MLA Humayun Kabir, a former member of Trinamool Congress who has floated his own political party, to approach the Union Ministry of Home Affairs seeking Z+ security. Notably, Kabir founded the Janata Unnayan Party last year. Kabir had submitted that he was a member of West Bengal Legislative Assembly under the banner of the ruling political dispensation and has presently formed his own political party. He said he apprehends threat to his life and property and seeks deployment of police personnel, preferably of Z+ category for his protection.The bench of Justice Suvra Ghosh said:"The petitioner is at liberty is submit a comprehensive representation before the 4th respondent (MHA) demonstrating the circumstances under which he requires deployment of police personnel for security and protection. On receipt of such representation, the 4th respondent shall deal with the same in the light of the facts and circumstances stated therein and take necessary steps in accordance with law, preferably within two weeks from the date of receipt of the application". The counsel for the State placed a report indicating that the petitioner was already provided with substantial police protection by Murshidabad District Police. The report further disclosed that two armed police constables have been assigned for personal security for several years and that such protection continues to date. The State further submitted that the district police have been consistently covering all political and public programmes conducted by the petitioner, and no untoward incident has occurred so far. The counsel for the Union Government submitted that the matters relating to personal security fall under Schedule VII, List II of the Constitution, which is within the exclusive domain of the State Government. However, the counsel also submitted that the petitioner could approach the Ministry of Home Affairs (MHA) for enhanced security. At this stage the petitioner's counsel said due to formation of new political party by the petitioner there may be differences between the district police and the petitioner and the petitioner seeks leave to submit the representation before the Ministry of Home Affairs (respondent 4) for deployment of police personnel for his protection subject to payment of requisite cost. Granting this liberty the court disposed of the plea. "It is made clear that this Court has not gone into the merits of the case and the 4th respondent shall be at liberty to deal with the representation submitted by the petitioner in accordance with law. The writ petition is accordingly disposed of.Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted," the court added.
