Delhi High Court To Pass Order Protecting Personality Rights Of Shark Tank Judge And Entrepreneur Aman Gupta

The Delhi High Court will be passing an interim order protecting the personality rights of Shark Tank India judge and co-founder of Indian electronics brand boAt Lifestyle, Aman Gupta.
“We will pass an order,” Justice Tushar Rao Gedela said on Thursday (May 7) after hearing the parties.
Senior Advocate Diya Kapur along with Advocate Nakul Gandhi appeared for Gupta.
At the outset, Kapur handed over to the Court a chart of all the infringing content as well as various orders in personality rights cases.
Kapur took the Court through the infringing content which included commercial exploitation through event booking websites, fake commercial endorsements, sale of merchandise sold under Gupta's name and registered trademark “Hum bhi bana lenge”, AI chatbots and vulgar content.
She said that the defendants were using the personality traits of Gupta unauthorizedly, without consent and prayed that the same be taken down.
The counsel appearing for Google said that while some content can be taken down, removal of links pertaining to memes and innocuous content may be difficult.
On this, the Court said that every content need not be taken down, while also indicating that an interim order will be passed in favour of Gupta.
It may be noted that the Court has been protecting the personality rights of Telugu actor Allu Arjun, Malayalam actor Mohanlal, spiritual preacher Aniruddhacharya, singer Jubin Nautiyal, Deputy Chief Minister of Andhra Pradesh Pawan Kalyan, former cricketer Sunil Gavaskar, and actors Kajol Devgan, R Madhavan and NTR Junior. Similar suit has been filed by actor Salman Khan.
The coordinate benches have also passed orders protecting the personality rights of “The Art of Living” foundation founder Sri Sri Ravi Shankar, Telugu actor Nagarjuna, Bollywood actors Aishwarya Rai Bachchan, Abhishek Bachchan and film producer Karan Johar.
Notably, the Court also protected the personality rights of journalist Sudhir Chaudhary, who had sought relief regarding the circulation of allegedly misleading and AI-generated videos against him on social media.
The Court also passed a john doe order protecting the personality rights of podcaster Raj Shamani, observing that he is a known face in India, especially in the field of content creation.
