Delhi High Court Grants Injunction To Hero Investcorp; Restrains Sale Of Counterfeit 'Hero Genuine Oil' Bottles Imitating Registered Design

The Delhi High Court on October 10 granted an ex-parte ad-interim injunction in favour of Hero Investcorp Pvt. Ltd., restraining a Delhi-based trader from manufacturing and selling counterfeit 'Hero Genuine Oil' bottles that infringed the company's registered trademarks and bottle designs. Justice Tejas Karia while passing the order observed that the impugned bottles were identical in design and labelling to 'HERO', creating a clear likelihood of confusion among consumers. Hero Investcorp, which owns the registered 'HERO' trademarks stated that their 'Hero Genuine Oil' products are marketed in bottles with a distinctive shape and design registered under the Designs Act, 2000. According to the company's investigation conducted in October 2025, a Delhi-based trader was manufacturing and selling counterfeit engine oils packaged in bottles identical to Hero's registered design and bearing the 'HERO' logo. As part of the evidence, photographs presented before the Court showed stacks of engine oil bottles, labels and packaging materials bearing Hero's mark, allegedly stored by Delhi trader for sale and distribution. After examining the evidences, the Court held that Hero's trademarks and designs had acquired substantial reputation and goodwill in the automobile sector. The Court observed that the trader's use of identical marks and packaging was clearly intended to mislead consumers into believing that the products belonged to Hero. “The products such as engine oil / automotive lubricant are purchased by a wide spectrum of consumers on the strength of brand value, quality, and reliability. The circulation of Counterfeit Products without any quality assurances is bound to erode consumer trust and confidence in the Plaintiffs' products and tarnish the reputation built over decades of trade, both in India and internationally.”, the Court said. Observing a clear prima facie case and the likelihood of irreparable harm, the Court restrained the trader from using the 'HERO' mark or any similar packaging. It further appointed a Local Commissioner to visit the trader's premises and seize the counterfeit products, packaging materials and other related items.
