Delhi High Court Disposes Meta's Execution Plea, Notes Compliance In “FACEBAKE” Trademark Case

    The Delhi High Court has disposed of an execution petition filed by Meta Platforms Inc. (formerly Facebook), after finding that the operators of the “FACEBAKE” and “FACECAKE” brands have substantially complied with an earlier injunction restraining use of marks deceptively similar to Meta's “FACEBOOK” trademark.

    Justice Manmeet Pritam Singh Arora passed the order on December 24, 2025, while examining compliance of a judgment and decree dated July 6, 2022, that had permanently restrained the use of the marks “FACEBAKE” and “FACECAKE,” related domain names, email addresses and had awarded nominal damages of ₹50,000 and costs in favour of Meta.

    Meta submitted that the restrained parties continued to use the infringing marks and delayed payment of damages and costs. The bakery outlets, however, stated that all outlets earlier operating under the “FACEBAKE” and “FACECAKE” names had been rebranded as “BUNCAKE” and that infringing signboards had been removed.

    The court noted that Meta later confirmed that the remaining instances of infringement pointed out during the execution proceedings had been remedied.

    On the issue of damages and costs, the court recorded Meta's complaint of a three-year delay in receiving the decretal amount. However, the record showed that the business operators had repeatedly sought Meta's bank details to make the payment. The court noted that the amount was eventually paid on September 16, 2025, and observed that “it was the decree holder (Meta) who exhibited a lack of initiative in accepting the monies awarded under the decree dated 06.07.2022.

    In these circumstances, the court held that the decree relating to damages and costs stood satisfied and that the permanent injunction had been complied with to Meta's satisfaction. The execution petition was accordingly disposed of, with the clarification that the injunction will continue to operate and that Meta may seek fresh relief in the event of any future violation.
