Delhi High Court Issues Summons On Trademark Infringement Suit By Footwear Brand Campus Against Apparel Brand Campus Sutra

The Delhi High Court has issued summons on a trademark infringement and passing off suit filed by footwear brand Campus against online apparel wear brand Campus Sutra.The dispute primarily pertains to standalone usage of mark 'Campus' by the latter.Justice Amit Bansal has asked the company to file its reply within four weeks and has listed the matter on November 10.Meanwhile, Campus Sutra has undertaken not to use the mark 'CAMPUS' on a stand-alone basis, in respect of any of its products.Senior counsel appearing for the defendant-company submitted that they have been using the mark 'CAMPUS SUTRA' for its apparel since 2012 however, they have never used the 'CAMPUS' mark for footwear.It was submitted that inadvertently 3 out of 11,000 designs of the defendant that bore the mark 'CAMPUS', on a stand-alone basis, got listed and the defendant has already written to various platforms where these products are to be sold, to remove the listings of the said products.Campus has sought to restrain the defendant from selling the products bearing the marks CAMPUS/CAMPUS SUTRA, or any other marks which are deceptively similar to its registered mark.“Written statement shall be filed by the defendant within thirty days from today…Liberty is given to the plaintiff to file replication, if any, within thirty days from the receipt of the written statement,” the Court ordered.It also recorded that the parties are amenable to exploring the possibility of arriving at an out-of-court settlement.Appearance: Mr. Sandeep Sethi, Senior Advocate with Mr. Samudra Sarangi, Ms. Shruti Raina, Ms. Saloni Jain, Ms. Priyal Sarawagi & Mr. Paritosh Tengshe, Advocates for Plaintiff; Mr. Amit Sibal, Senior Advocate with Mr. Saurav Agarwal, Mr. Adarsh Ramanujan, Mr. Asav Rajan, Mr. Ajay Sharma, Ms. Kashish Chadha, Mr. Devang Shrotiya, Mr. Akash Saxena & Mr. Aditya Shah, Advocates for DefendantCase title: Campus Activewear Ltd v.
