The Delhi Police on Tuesday moved the Delhi High Court challenging the order passed by the National Human Rights Commission (NHRC) casting aspersions on it over the alleged failure and negligence in carrying out its duty over an incident where a murder accused, lodged in city's Tihar jail, was taken to a court in Uttar Pradesh's Bijnor and was shot dead there.

Justice Subramonium Prasad issued notice on the plea and stayed the portion of NHRC's order directing the Delhi Police to pay compensation of Rs. 7 lakh over the death of the undertrial prisoner, Shahnawaz Ansari.

Shahnawaz was accused of double murder. He was shot inside a courtroom in Bijnor on December 17, 2019, while the proceedings were going on. He was taken by the Delhi Police for his production in Bijnor before the concerned Chief Judicial Magistrate.

It was the Delhi Police's case that the police personnel who escort an accused to the court are unarmed and that it was the Uttar Pradesh Police's failure in not ensuring adequate safety and security arrangements inside the court.

The court directed the State to implead the Uttar Pradesh Police as a party respondent in the matter.

It further appointed an amicus curiae to assist the court. The name of the concerned lawyer will be reflected in the order once uploaded.

The matter will now be heard on July 18.

As per news reports, deceased Shahnawaz Ansari was accused in the double murder of Bahujan Samaj Party leader Haji Ahsan Khan and his nephew. He had surrendered in the national capital.
