Delhi High Court Permits 100% Visually Impaired Woman To Live With Partner Despite Father's Objection, Says Adult Free To Decide Residence

The Delhi High Court has permitted a 100% visually impaired adult woman to reside with her partner of choice, reiterating that a major is free to decide her residence, irrespective of parental objections.
A division bench of Justices Navin Chawla and Ravinder Dudeja was hearing a habeas corpus petition filed by the woman's partner, who alleged that she was being confined by her parents against her wishes.
Pursuant to the Court's earlier directions, the woman appeared before the bench in person. The Court interacted with her, her father, and the petitioner.
During the interaction, the woman unequivocally expressed her desire to reside with the petitioner and stated that they intended to get married. The petitioner also affirmed his willingness for her to live with him.
The woman's father, however, opposed the relationship and submitted that he would sever ties with his daughter if she chose to go with the petitioner.
Taking note of the woman's clear and voluntary statement, the Court held that since she is a major, she is free to decide her residence. It accordingly permitted her to leave with the petitioner.
However, keeping in view the sensitivity of the issue involved and apprehension expressed by the Petitioner, the Court requested the State to ensure that the duo are provided with an escort to drop them at the place where they wish to reside for the present.
Additionally, a Beat Constable was directed to share contact details with them to ensure assistance in case of any emergency.
