Delhi High Court Questions Priya Kapur For Sealed Cover Disclosure Of Sunjay Kapur's Assets In Suit Filed By Karisma Kapoor's Children

Late industrialist Sunjay Kapur's wife Priya Kapur has moved a fresh application before the Delhi High Court on Thursday (September 25) seeking permission to file list of personal assets and liabilities of her late husband in a sealed cover with the parties to be bound by confidentiality, or in the alternative constitution of a Confidentiality Club.Kapur has moved the application claiming that there is a financial implication and that pleadings are being leaked to the media.After hearing the matter for some time, Justice Jyoti Singh listed the matter on Friday after Kapur's counsel said that she will come with a suggestion which will be holistic. Appearing for Priya Kapur senior advocate Sheyl Trehan submitted that she was requesting that the list of personal assets and liabilities of her client's late husband be filed in a sealed cover. The court however orally said that in any partnership suit, list of assets are disclosed. "I'm saying to them I will disclose in sealed cover on an undertaking of confidentiality. I'm not shying away from giving it to anyone. All the parties may have it," Trehan said. The court asked what was exceptional in the present case. Trehan then said, "There has been a lot of media attention. Pleadings have been leaking. After hearings are over there are press conferences being held at the gate outside. What is happening over here is a situation where everything is being leaked...it is a question of cyber security."She said that there are bank and DMAT account details as well adding, "We are not shying away from giving it to them. Let them simply keep it confidential...Details are so specific. Why should public at large have somebody's bank account number. I'm giving it to everybody...my only request is I can file it in sealed cover so that it does not leak to public at large and media and that it be under confidentiality of the parties, that's all". The court however orally said, "tomorrow like any other suit when you file your written statement, you will set up a defence of Will...how will they file replication if they don't have these details...when they do they will file objections to list of assets...how much of it will go in sealed cover?"Trehan, "As far as I am concerned this is a lot of info to be in public for any human being". At this stage the court asked if there was a judgment on this in a partition suit. Trehan said, "On confidentiality club there is in commercial suits. The question is my need is different from somebody who has a commercial interest. Which is that I am willing to disclose the details to parties concerned...There is no prejudice caused to anyone here by my request". She further said she was only requesting for "two pages to be in a sealed cover". Meanwhile the plaintiff's counsel said that as per their information, "banks have been wiped off, there is nothing left in the bank account". "In so far as property is concerned, world show know at large that they don't have to deal with those properties...Its a proceeding in rem. Here they are producing a Will in written statement. Otherwise it is a citation in public. How much will go in sealed cover? Then they say given NDA. How will I verify...?" the counsel said.The court then orally said, "it is problematic...as alleged beneficiaries to the estate...have a right to question assets disclosed as in any other case. Tomorrow if they have to verify...and are bound by confidentiality club how will they defend this case?"The court then orally said that it is happy to accept any suggestion which does not affect rights of any party to defend its case. The court asked Trehan to place a precedent on the issue adding, "It is about suit proceedings going to trial tomorrow…if they (plaintiff) are not benefitted out of disclosure...how will they defend?"Trehan then asked that the matter be kept tomorrow and she will place a suggestion on the issue which is holistic and benefits everybody. Meanwhile senior advocate Amit Sibal appearing for Sunjay Kapur's mother (defendant 3) said, "I have right given I'm class 1 heir to verify the Will independently. NDA will affect that. Order should not come in the way… I have a right to defend the suit. I ask for copy I wasn't given. I need to verify it. NDA is somewhat unusual. My plea is I must be given a copy of the will". The court thereafter said to Trehan, "these NDA's are also unusual in partition suits. You address this also". Trehan said that she will address this issue as well. The matter is kept on Friday (September 26) at 2:30pm. The application has been filed in a lawsuit moved by Samaira Kapur and Kiaan Raj Kapur against their father Sunjay Kapur's second wife Priya Kapur and their son as well as the deceased's mother Rani Kapur and Shradha Suri Marwah- purported executor of a Will dated March 21, 2025.On September 10 the high court had directed late Sanjay Kapur's wife Priya Kapur to disclose all his assets in a suit filed by Bollywood actress Karisma Kapoor's children ...
