The Delhi High Court on Wednesday refused to entertain a PIL seeking stay on the theatrical release of the upcoming film “Suryaa: Ant Se Aarambh Tak” starring Bollywood actor Sunny Deol.

The movie is set to hit theatres on November 20.

“We see no reason to entertain the present PIL,” a division bench comprising Acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma said.

The Court noted that a single judge is already dealing with a similar plea which is coming up for hearing on November 16 and that there is no reason for multiplicity of proceedings.

The Court said that the Petitioners may join the proceedings before the single judge. It also gave them liberty to pursue their representation to the authorities.

The PIL was filed by Dr. Nachiketa Bhatia and Dr. Dhruv Chauhan. They challenged the movie release on the grounds that its official trailer depicts physical violence against medical personnel as heroic and unfairly generalizes corruption in the healthcare profession.

As per the Petitioners, the conduct violates Section 5B of the Cinematograph Act, 1952, and threatens public law & order.

The petitioners sought directions on the Union Ministry of Information and Broadcasting and the CBFC to examine and modify or delete allegedly objectionable scenes or dialogues from the film.

They further sought an ad-interim ex-parte stay on the film's public screening pending statutory examination.

The plea was filed through Advocates Satyam Singh Rajput and Neema.

During the hearing today, the counsel appearing for the petitioners said that the issue is sensitive and that scope in a PIL will be more than proceedings in a writ petition.

The counsel appearing for CBFC said that till now, no certification has been issued to the film and the same is pending consideration.

The counsel appearing for petitioners said that the language used in the teaser gives an impression that relatives of the patients now can resort to violence against doctors and medical personnel.

He said that a representation has already been made which is similar to pleadings in the PIL and that the same be decided.

However, the Court said that it was not inclined to entertain the PIL as similar petition is already pending consideration before single judge.
