    The Delhi High Court has asked a private school in the national capital to restore a Class X student's admission whose name was struck off over non payment of fees, after a lawyer volunteered to contribute Rs. 2.5 lakh to clear the outstanding dues.

    Justice Vikas Mahajan appreciated the gesture of Advocate RK Kapoor, in coming to the aid of the student and ensuring that his family's financial difficulties do not impede his education.

    The plea was moved by the minor, Arnav Raj. An application was filed seeking modification of an earlier direction under which his father was required to pay Rs. 50,000 per month to clear dues of over Rs. 5.37 lakh and also continue paying regular fees.

    The Court was informed that although the father initially deposited Rs. 1.26 lakh, he was unable to continue payments after losing his job, coupled with the additional burden of medical expenses for the child's ailing grandfather.

    Following non-payment, the school had issued a show-cause notice and later removed the student's name on September 26.

    During the hearing on November 14, Advocate R. K. Kapoor, who was logged-in through VC for some other case, volunteered to pay part of the outstanding dues looking at the plight of the father.

    Kapoor volunteered to contribute Rs. 2.5 lakh against the outstanding fees of Rs 5,32,375 as alleged by the school. However, the student's said that the outstanding amount was Rs 4,11,000 after adjustment of an amount of Rs 1,26,000, which was already paid by the father.

    Accordingly, the Court said:

    “Be that as it may, in the peculiar facts and circumstances of the present case and regard being had to the fact that the petitioner is a student of Class X, whose father owing to his financial difficulties has not been able to arrange for the outstanding school fee of the petitioner, leading to the striking off his name from the school, the school is requested to accept Mr. Kapoor's contribution of Rs 2,50,000/- towards the outstanding fees of the petitioner and consider the said payment as full and final settlement of all outstanding dues of the petitioner as well as remaining fee, if any, for academic session 2025-2026, and withdraw the office order dated 26.09.2025.”

    The judge added that for the next academic session, if the student continues in the same school, it shall be the liability of his parents to pay the fee regularly.

    The Court clarified that the order was being passed in the peculiar facts and circumstances of the case and the same shall not be considered as precedent.
