Delhi High Court Restrains YouTubers From Publishing 'Disparaging' Content Against AI+ Smartphones And Its Founder

The Delhi High Court has passed an ex-parte ad-interim injunction restraining certain YouTubers and unknown defendants from publishing or circulating allegedly disparaging content against 'AI+ Smartphones' and its founder.
Justice Tushar Rao Gedela was hearing a commercial suit filed by NxtQuantum Shift Technologies India, which markets smartphones under the brand 'AI+', along with its founder Madhav Sheth.
The plaintiffs alleged that certain YouTube videos contained false, misleading and defamatory statements about their products, including claims relating to data security, privacy practices and the company's origins.
According to the plaintiffs, the videos—published by popular tech content creators—were presented as product reviews but in fact contained unverified allegations intended to damage the company's goodwill and discourage consumers from purchasing its products.
It was further alleged that the content questioned the credibility of the founder and suggested links with foreign entities, thereby harming the brand's “India-first” positioning.
The Court examined transcripts of the videos and noted that while some portions appeared to be in the nature of criticism, the overall content did not disclose any verifiable technical analysis or objective comparison to substantiate the claims made.
“The transcripts appear to suggest that the consumers ought not to invest their money into purchasing the products of the plaintiff, predicated on the analysis done by the defendant nos.2 and 3. This untested and unverified analysis has the potential of causing financial loss to the plaintiffs,” it observed,
“The transcripts of both the videos appear to display a fair criticism of the purported shortcomings, in the opinion of the defendant nos.2 and 3, however, appear to be unfairly targeting the plaintiff no.1 and more particularly plaintiff no.2,' it further said.
Adding that the impugned videos “border on disparagement”, the Court said a prima facie case is made out by the company.
So far as its Founder is concerned, the Court said while the Suit is not predicated on any personality right yet, cumulatively reading the transcripts tends to bring disrepute to him.
As such, the Court restrained the defendants from disseminating any content amounting to disparagement of the plaintiffs' products or their founder.
The matter will now proceed for further hearing on October 05.
