Delhi High Court Seeks HDFC's Response On Customer's Plea Alleging ₹74 Lakhs Fraud Transaction Through Unauthorised 'Virtual Debit Card'

The Delhi High Court has issued notice to the Reserve Bank of India, RBI Banking Ombudsman and the HDFC Bank on a customer's plea alleging that he was defrauded of ₹74 lakhs, by creation of a virtual debit card without his authorisation.Justice Vikas Mahajan directed the respondents to file their counter-affidavits in the matter in four weeks.As per Petitioner-Manmohan Kumar, fraudulent transactions totalling Rs.74,61,990/- were carried out in his HDFC bank account. He submitted that his registered mobile number and e-mail ID connected to his bank account were changed without his consent or authentication.Though the bank initially reversed the transaction, it later, unilaterally, debited his account— leaving it with a negative balance.The Bank denied there being any deficiency of service on its part and stated that the transactions were duly authenticated vide OTPs, attributing the fault to the petitioner. As the Banking Ombudsman also closed his complaint, he moved the High Court.Counsel appearing on behalf of the petitioner submitted that the respondents are trying to put the blame on him while refusing to offer any explanation for the fraudulent creation of a virtual debit card and the unauthorized alteration of his registered contact details.He submitted that the same could only be done with the requisite debit card credentials and OTP based validation that could only be available with the petitioner but, the petitioner had never shared such credentials with anyone.After hearing the submissions, the Court listed the case for hearing on July 29.Appearance: Mr. Siddharth Batra, Mr. Rhythm Katyal, Ms. Archna Yadav and Ms. Shivani Chawla, Advs. for PetitionerCase title: Manmohan Kumar v.
