The Delhi High Court's administrative side is set to consider framing appropriate rules or amending the existing rules to streamline the procedure to expedite proceedings before the Family Courts in the national capital.

The development ensued after a division bench comprising Acting Chief Justice Vibhu Bakhru and Justice Tushar Rao Gedela passed an order while while disposing of a PIL on the issue.

The plea was moved by one Ishan Tiwari highlighting the requirement for expediting hearing in the cases pending before the Family Courts here.

Tiwari made certain suggestions for amending the Delhi Family Courts Rules, 1996, for expediting the proceedings and alsofor specifying certain timelines to do the same.

His counsel handed over to the Court a copy of the decision Kerala High Court in Shiju Joy v. Nisha wherein certain directions were issued for streamlining the procedure before Family Courts.

It was submitted that the Delhi High Court has necessary powers to make amendment to the rules and procedure to be followed by the Family Courts.

Accordingly, the Court directed that Tiwari's suggestions be placed for consideration on the administrative side for framing or amending the rules for streamlining the procedure to be followed by the Family Courts.

“Let this order be placed before Hon'ble the Chief Justice/Acting Chief Justice on the administrative side of the court. The petition is disposed of with the aforesaid directions,” the Court said.
