Delhi High Court Issues Dynamic+ Injunction Protecting Copyrighted Works Of Global Entertainment Companies Including Universal City Studios

The Delhi High Court has issued a dynamic+ injunction protected the copyrighted works of various global entertainment companies, including Universal City Studios.
Justice Manmeet Pritam Singh Arora restrained 106 rogue websites from hosting or streaming the cinematograph work or content in relation to which the entertainment companies have copyright or exclusive distribution rights.
The Court directed the DNRs to lock or suspend the rogue websites in question and further ordered the internet service providers to block access to the websites.
“Defendant Nos. 139/DOT and 140/MEITY, are directed to issue a notification calling upon the various internet and telecom service providers registered under it to block access to the Defendant Nos. 1 to 106 websites identified by the Plaintiffs…and any such other mirror/redirect/alphanumeric website which appears to be associated with any of the Defendant Websites…,” the Court ordered.
The Court passed the ad interim order in the entertainment companies' suit against the rogue websites alleging that they were illegally hosting and streaming their copyrighted content.
Justice Arora passed the dynamic+ injunction in favour of the plaintiff companies to keep up with the hydra-headed nature of the infringement actions of such infringing websites and to protect copyrighted works as soon as they are created.
It added that such an order will ensure that no irreparable loss is caused to the owners of copyrighted works, as there is an imminent possibility of works being uploaded on infringing websites or their newer versions immediately thereafter.
“If any website, which is not primarily an infringing website, is blocked pursuant to the present order, they shall be permitted to approachthe Court by filing an Affidavit that it does not intend to engage in any unauthorized or illegal dissemination of cinematograph films/ shows or any other content over which the Plaintiffs have rights. In such a situation, the Court would consider modifying the injunction as the facts and circumstances so warrant,” the Court said.
