The Delhi High Court on Friday deferred consideration of Bollywood actor Salman Khan's plea seeking to restrain the release of the proposed film "Kala Hiran: The Battle for Legacy", which is stated to be inspired by his 1998 blackbuck poaching case and his alleged rivalry with gangster Lawrence Bishnoi.
A vacation bench comprising Justice Madhu Jain directed that a complete copy of the plaint and accompanying documents be supplied to the respondent filmmaker and listed the matter for hearing on July 1, without granting any interim relief at this stage.
As per Khan's counsel advocate Nizam Pasha, poster and trailer of the film have been released but release date of the film is yet to be announced.
"He's producing a film on my life...he has no right...I have not authorised him," Khan's counsel told the Court today. He also pressed for interim relief in the matter.
It is alleged that the proposed movie unlawfully exploits his personality rights and falsely portrays events associated with him. An application opposing its release has been filed in the actor's suit seeking protection of his personality rights.
However, the filmmakers submitted that they have not been served all the materials. "On Wednesday they served me only copy of application, not plaint," the counsel submitted. He added that the filmmakers are receiving death threats over the film and a FIR has been lodged.
Eventually, the Court directed the actor to supply complete set of documents along with plaint to the Respondent and listed the case for arguments on July 01.
Shortly thereafter, Khan's counsel mentioned the matter again and submitted that the filmmakers had already been served. He therefore pressed for a short date.
However, the Court noted that the case has already been listed in July.
The actor contends that promotional material released by the makers contains unmistakable references to him, including the depiction of a lookalike wearing his iconic blue bracelet, which has become uniquely associated with him in the public imagination.
The plea further alleges that one of the posters depicts the lookalike holding a rifle or gun, thereby creating a misleading narrative contrary to judicial records.
As per the actor, such portrayal is particularly objectionable in light of his acquittal in proceedings under the Arms Act and is capable of misleading the public regarding actual events.
Advocates Nizam Pasha, Siddharth Kaushik, Parag Khandar, Chandrima Mitra, Krishnan Kumar, Tapan Radkar and Zara Dhanboora appeared for the actor.
