The Mizoram government on Wednesday (November 27) informed the Gauhati High Court at Aizawl that it has constituted the State Human Rights Commission under the provisions of Section 21(4) and (1) of the Protection of Human Rights Act, 1993 with its Headquarters at Aizawl.
The division bench of Justice Nelson Sailo and Justice Marli Vankung was further informed by the State Government that a notification in respect of creation of sixteen posts which includes Chairperson, two Members, Officers and Staffs for the new establishment has been issued.
The Court was hearing a PIL on the issue, during the hearing of which, it was stated by the Government Advocate that State Authorities are in the process of considering the appointment of suitable persons as Chairperson and members of the Commission, apart from looking for an appropriate building to house the new establishment.
Petitioner had submitted a proposal to the State Government for appointment of the Chairperson and the other two Members of the Commission for their consideration.
The Court observed:
“Having regard to the aforesaid development, we have noticed that some positive steps have been taken by the State respondents in furtherance of the establishment of the Human Rights Commission in the State of Mizoram. However, it goes without saying that the State respondents will have to take further steps to establish the Commission by appointing suitable persons as its Chairman/Chairperson and members apart from filling up the posts which have been created so that the Commission can be set in motion.”
The Court adjourned the matter for eight weeks.
“In the meantime, the respondents shall file an additional affidavit incorporating the notifications which has been produced and also inform the Court all the steps for establishment of the Commission pursuant to the issuance of the said Notifications dated 11.10.2024,” it added.
