Gujarat HC Issues Notice On Man's Plea For Correction Of Low CIBIL Score Caused By Loan Repayment Notices Issued Due To Alleged Mistaken Identity

The Gujarat High Court issued notice on a man's plea seeking a direction to Rajkot Nagrik Sahkari Bank to correct his low CIBIL (Credit Information Bureau India Limited) score on the ground that "wrongful notices" were issued to him by the bank to repay a loan due to an alleged case of mistaken identity.Justice Aniruddha P. Mayee in his order said, “Heard the learned counsel for the petitioner. Issue Notice, returnable on 25.04.2025.”It was stated in the plea that the petitioner–Praveenbhai Mohanbhai Rathod received multiple notices from Rajkot Nagaril Sahakari Bank Ltd. between February to October 2019 demanding repayment of outstanding loan taken by two individuals, wherein the petitioner was mistaken for another person with the same name who had actually signed up as a guarantor for the loans taken by these two individuals.Upon receiving such notices, the petitioner wrote a letter to the RBI on July 2019. The RBI in its response stated that it had initiated an investigation. Thereafter the Rajkot bank issued an apology letter to the petitioner clarifying that a different individual with the same name had signed up as a guarantor with the bank. The letter said that the since the petitioner's account is also in the respondent bank and due to him having similar name as the guarantor, the petitioner had been receiving notices. The letter further said that corrections had been made so that the petitioner does not face any problem in future. However when the petitioner checked his CIBIL score it reflected low. The plea states that petitioner had made a detailed representation to the Rajkot Bank on November 27, 2019 however no action or concrete steps were taken. Therefore, the petitioner moved to the High Court directing the Rajkot Bank to correct his CIBIL score.The plea further seeks that pending the final disposal of the plea, the RBI may be directed to initiate legal action or inquiry against the bank for "using fraud entry in the loan account" and using petitioner's personal details without his permission.
