Surat Rape Case: Gujarat High Court Grants Narayan Sai 5-Day Temporary Bail To Meet Ailing Mother

The Gujarat High Court on Thursday (September 18) granted five-day temporary bail to Narayan Sai–convicted and sentenced to life by sessions court in 2019 in a rape case– to meet his "ailing" mother.A division bench of Justice Ilesh J Vora and Justice PM Raval in its order said:"Having regard to the peculiar facts and circumstances and grounds urged in the application and having regard to the period of incarceration, case is made out for releasing the applicant on temporary bail for a period of 5 days from the date of his release with police surveillance".The court directed the concerned authority to release the applicant on temporary bail for 5 days with police (surveillance) to meet his ailing mother, adding that the applicant shall not be permitted to reside or visit at any other place, except the residence of his mother and after completion of five days, he shall be brought back to the jail."The convict shall not meet his followers or followers of his father in a group," the bench added. Appearing for applicant, advocate Dharmendrakumar Mishra, submitted that, the applicant lastly met his ailing mother in February, 2021 and since then, he has been unable to meet her. He said that the applicant's mother is suffering from heart ailment and her medical condition is critical and therefore, the applicant may be enlarged on temporary bail.Meanwhile the State Counsel Pranav Dhagat and advocate Nandish Thakkar appearing for the victim, have stated that, there is no medical evidence on record to the effect that mother is in critical condition and therefore, no case is made out and further they prayed that the application may not be entertained. Partly allowing the application, the court disposed of the same.Sai was convicted by the Sessions Court, Surat on April 30, 2019 for offences punishable under IPC Sections 376(2)(f) (being a relative, guardian or teacher of, or a person in a position of trust or authority towards the woman, commits rape on such woman), 376(k) (commits rape on a woman suffering from mental or physical disability) 376(n) (commits rape repeatedly on the same woman), 377 (Unnatural Offences), 354 (Assault orCriminal Force to Woman with Intent to Outrage Her Modesty), Section 323(Voluntarily Causing Hurt), Section 504 (Intentional Insult) and Section506(2) (Criminal Intimidation) of Indian Penal Code.He was sentenced to rigorous imprisonment for life and has been incarcerated since December 2013.Notably the applicant's father Asaram Bapu was asked to surrender by the Rajasthan High Court by August 30 in a separate rape case.
