Gujarat High Court Asks State Govt To Submit Current Policy On Remission & Premature Release Of Convicts

The Gujarat High Court on Monday (January 5) asked the State government to place on record the current policy on remission and premature release of convicts applicable in the state. A division bench of Justice Ilesh J Vora and Justice RT Vachhani in its order noted that the bench had been constituted to monitor and supervise the implementation of the remission and the premature release policies of the respective states by the Supreme Court. For context the Supreme Court had in February 2025 directed states to consider premature release of convicts when they become eligible even without their applications. Thereafter the Supreme Court had directed the States and Union Territories to submit affidavits within two months reporting compliance with its directions to adopt or implement an exhaustive policy on premature release, ensure automatic consideration of eligible convicts under such policy, impose reasonable conditions for remission, record reasons for grant or rejection, and not cancel remission without hearing the convict.Meanwhile the Supreme Court in its order dated November 4, 2025 noted that the State of Gujarat had filed compliance affidavit and had directed its registry to serve it upon the concerned amicus curiae. During the hearing on Monday, Government Pleader GS Virk submitted that so far as Gujarat is concern, there is full compliance of the directives of the Supreme Court issued time to time in its various judgments."In such circumstances, in order to examine the compliance as well as the current policies, we request the State counsel to place on record the copies of the current policies on the aspect of remission and copy of the compliance report served to the Amicus curiae as referred in the judgment of the Hob'ble Supreme Court," the bench added.
