The Gujarat High Court on Monday (September 7) granted 7-days temporary bail to Aam Aadmi Party MLA Chaitar Vasava–convicted for assaulting and extorting forest officials in a forest land encroachment case, to enable him to attend the Legislative Assembly session. 

Vasava had moved the high court seeking 15 day temporary bail from  07.09.2026 to 21.09.2026, to attend the 9th Assembly Sessions of the Gujarat Legislative Assembly scheduled to be held between 08.09.2026 and 10.09.2026. 

Justice Vimal K Vyas in his order said:

"Having considered the averments made in the application and the fact that the present applicant-convict is a sitting MLA and is invited to attend the Assembly Session of the Legislative Assembly along with the fact that the present applicant-convict is in judicial custody since June 2026, the present application deserves consideration. The application is allowed. The applicant-convict is hereby ordered to be released on temporary bail for a period of seven days from the date of his actual release, upon his executing a personal bond of Rs.15,000 (Rupees Fifteen Thousand) before the jail authority...."

The court imposed various conditions including that the applicant shall not leave Gandhinagar city, he shall not address any public gathering and he shall not appear before the media.

"The applicant-convict shall surrender before the jail authority immediately on completion of his temporary bail period, without fail. It is hereby clarified that no further extension shall be granted in any case," the court directed disposing of his plea for temporary bail. 

Vasava was convicted by the trial court under various provisions including IPC Sections 143(Punishment for being a member of an unlawful assembly), 147(Punishment for rioting), 148(Rioting while armed with a deadly weapon), 149(common object), 189(Threat of injury to a public servant to deter them from their duty), 332(Voluntarily causing hurt to deter a public servant from their duty), 353 (Assault or use of criminal force to deter a public servant from discharging their duty), 386 (Extortion by putting a person in fear of death or grievous hurt) among others.

He was sentenced to seven years. The high court had in August refused to suspend his sentence
