Karnataka High Court Seeks Details From NCLT Bengaluru On System To Date & Time Stamp Orders While Uploading

The Karnataka High Court on Monday directed the Registrar of the National Company Law Tribunal, Bengaluru, to place on record if there is a system implemented by it for date and time stamping, while uploading interim or final orders.
Justice Suraj Govindaraj directed the Registrar to give details by December 17. The bench orally said, “In the High Court we are getting date and time stamps on the orders, we will direct the same to be implemented by NCLT.”
The court gave the direction while hearing a petition filed by Phoenix Arc Private Limited, which has approached the court seeking directions to the NCLT to forthwith issue, publish, release, upload and make available the written and signed orders passed on application, which were orally pronounced July 29, expeditiously and in any event within a period of one week.
Senior Advocate Dhyan Chinnappa, appearing for the petitioner, informed the court that he had even moved the National Company Law Appellate Tribunal (NCLAT) which also directed the NCLT to furnish the order but even today the order is not made available.
Counsel for NCLT Advocate M N Kumar on instructions from the Deputy Registrar NCLT submitted that order is uploaded today.
The bench orally said “Orders should be uploaded maximum within a week.” Following which it noted in its order “Counsel for R1, R2 on instruction from Deputy Registrar NCLT Bengaluru, submits that it has been uploaded. He is directed to place it on record when it is released/uploaded and if there is a system implemented by R2 for date and time stamping of the uploading the interim or final orders.”
