'Authorities Must Have Their Say': Karnataka High Court Declines Interim Plea To Change Route For Ganesh Visarjan Procession

The Karnataka High Court on Wednesday (September 3) refused to consider the interim prayer made by an unregistered organisation to undertake the procession of immersion of Ganesh Idol through a particular route in Mandya District. Justice B M Shyam Prasad refused relief to petitioner Saamuhika Ganapati Visarjana Samithi. Senior Advocate Arun Shyam appearing for the petitioners relied on SC judgments and contend that petitioners have a right to take out their procession through a route that is convenient and when apprehension has been expressed about possible consequences the courts have intervened. However, the government advocate underscored that in the previous year when the procession was taken on the route that is insisted upon by the petitioners there were untoward incidents with loss to life and property. As also the fact the petitioners have filed the petition yesterday with a request for listing today and orders on interim prayer. The bench in its order said, “The first petitioner is an unregistered organisation which is permitted to undertake a procession for immersion of Ganesh Idol taking a particular route. The petitioners have sought for change of the route and their grievance is that the authorities have not considered those representations favourable.” It added “This court, notwithstanding the grounds urged, is of the view that there must be circumspection and authorities must have their say before there could be an order. As such the petitioner request for interim order to take the procession through a particular route as mentioned in the interim prayer, is not considered for the present occasion.” Further, it said “The respondents are called upon to complete their pleadings in four weeks so that the petitioner grievance as against the coming years could be examined, in all of its ambit.
