Kerala High Court Closes PIL For CBI Inquiry Into 'Attack' On ED Officials After Search At Ex-CM's Home, Cites Satisfactory Progress In Probe

The Kerala High Court on Friday (03 July) disposed of the PIL seeking CBI enquiry into the alleged "attack" on Enforcement Directorate (ED) officials following the agency's search operation at the residence of former CM Pinarayi Vijayan and his daughter on May 27. [2026 LiveLaw (Ker) 357]
The Chief Justice Soumen Sen and Justice Syam Kumar disposed of the petition after taking note of a report by the State observing that "there is satisfactory progress in the investigation".
During the previous hearing, the Court had directed the State to file an affidavit detailing the steps taken pursuant to the FIR filed over the "attack".
Today, a statement was filed by the Commissioner of Police Thiruvananthapuram City that the investigation is progressing in the right direction.
According to the statement filed, crime has been registered at Museum Police Station under various provisions of the Bharatiya Nyaya Sanhita (BNS) and the Prevention of Damage to Public Property Act. Investigators have collected scientific, forensic, photographic and videographic evidence from the scene, including multiple material objects such as glass fragments, soil samples and other physical evidence.
The police stated that 25 accused persons have so far been identified, arrested and remanded to judicial custody, adding that the investigation remains ongoing. The statement also notes that medical records of both injured ED officials and injured accused have been collected as part of the probe.
It is also stated that notices were issued to several media organisations to obtain video footage of the incident, while statements from 44 witnesses have already been recorded. The police also stated that additional suspects are being identified from the available video evidence.
The State denied that there had been any prior intelligence warning about the alleged attack or any intelligence failure. It maintained that police personnel were mobilised immediately after receiving information about the disturbance and that prompt action prevented further escalation.
The State also disputed the petitioner's allegations of a biased investigation, shielding influential individuals, interference by trade unions and tampering with digital evidence, describing them as unsupported assertions.
The Court on receiving the affidavit observed that the investigation is progressing satisfactorily and disposed on the petition.
"Based on the Report Filed by the State, there is satisfactory progress in the investigation. We do not find any reason to direct an investigation by CBI at this stage. Matter shall be disposed of." Court ordered.
Notably, a plea seeking cancellation of Bail granted to one of the accused in the case is pending before a Single Bench.
