The Kerala High Court on Thursday (February 12) granted two more weeks' time to the State government to file counter affidavit in the public interest litigation preferred by Kerala University ex-Joint Registrar, challenging the assignment of the varsity's land to AKG Centre for Research and Studies in the year 1977.
When the matter came up for consideration before the Division Bench of Chief Justice Soumen Sen and Justice Syam Kumar V.M., the special government pleader sought time to trace out the government order that transferred the property to the AKG Centre.
The petitioner's case is that the afore government order could not be traced out by the Village Officer, District Collector or the Department of Archeology. He has also alleged that though only 15 cents is stated to have been assigned by the government order, the AKG Centre and CPI(M) are in possession of more than 55 cents of land, including the University property and government puramboke.
According to the State, some more documents are to be collected for filing an effective counter. During the last posting, the Court had granted 3 weeks for the State to file a counter and had orally remarked that the 1977 order was needed to justify the State's claim.
"How much time? And the last time. I mean the last chance," Chief Justice Sen orally remarked.
The special government pleader requested for two more weeks. Allowing the request, the Court posted the matter after three weeks.
The petition is moved by Senior Advocate George Poonthottam and, Advocates Nisha George and Akshara Raju.
