Dental Student Suicide | 'Medical Colleges Are Cruelly Treating Students': Kerala HC Orally Remarks In College HOD's Anticipatory Bail Plea

Hearing an anticipatory bail plea of the HOD of the College wherein a dental student allegedly committed suicide, the Kerala High Court on Monday (June 1) orally expressed concern at the seriousness of the matter, remarking that students were being treated cruelly in medical colleges in the State noting that there were many complaints. During the hearing, Justice A Badharudeen orally said: "In Kerala, medical colleges are ruining students. No doubt about it. They are very cruelly treating students, even PG students. Many complaints. Very, very serious matter...Generally.. I am not saying that you have done it.. Generally, these are very very serious allegations." The observations were made while considering an appeal against the order of the Sessions Court filed by Dr. M. Kodanda Ram, who is arrayed as the prime accused in the suicide abetment case of Dental College student Nithin Raj.Dr. Ram is the Head of Department of Dental Anatomy at Kannur Dental College where Nithin Raj was enrolled in and Dr. Nambiar Sangeetha is a professor there.The Session Court had earlier dismissed his bail application while granting pre-arrest bail to the second accused Dr. Sangeetha Nambiar.The prosecution counsel argued about the reasons for refusal to grant anticipatory bail to the accused and pointed out that the Session's Court had relied on the statement of the classmates of Nitin Raj (victim) while denying anticipatory bail to the accused. The Session's Court had recorded that there is prima facie evidence suggesting that Nithin Raj committed suicide on account of the fact that he was called into the principal's room and interrogated by his teachers.The prosecution further stated that the behaviour of the accused has been attested by other classmates of Nitin Raj as well. At this point, the High Court further orally said:"You discuss with the government, particularly, what is happening in Medical College. In many cases, many are not even disclosing...Seeing a bright future no student is ready to quarrel with the teachers and the college authorities. They are suffering. I think a committee is to be constituted, a secret report to be obtained on what is happening and what are the remedial measures." The Court further orally suggested that the Committee so constituted can inquire into allegations and form an opinion and then form guidelines or stipulations. During the hearing the appellant argued in detail about FIR relating to the a loan-app allegation and the connected crime registered. It was submitted that the Court had failed to properly appreciate the materials while dismissing the anticipatory bail application. The victim's father who is impleaded as a respondent was present in person before the Court and submitted that the advocate who he had appointed before has relinquished the Vakalath and sought time for appointment of a another advocate. The Court thus granted time and posted the matter on Monday for further consideration. "Post on Monday...Heard the learned counsel for appellant and Public prosecutor. The victim's father has appeared in open Court and submitted that the earlier counsel he had given up his vakalath and is trying to appoint another lawyer".The matter is listed on June 8.
