Dr. M. Kodanda Ram, who is alleged to be the prime accused in the suicide abetment case of Dental College student Nithin Raj, has moved the Kerala High Court seeking anticipatory bail.

Dr. Ram is the Head of Department of Dental Anatomy at Kannur Dental College where Nithin Raj was enrolled in and Dr. Nambiar Sangeetha is a professor there.

Last week, the Sessions Court, Thalassery had dismissed his bail application while granting pre-arrest bail to the second accused Dr. Sangeetha Nambiar.

The prosecution allegation is that the deceased student committed suicide due to the constant mental harassment of Dr. Ram. It is further alleged that Dr. Ram humiliated the deceased in front of his classmates, knowing fully well that he was a member of the Scheduled Caste community.

The offences alleged against him are those under Section 108 of Bharatiya Nyaya Sanhita (BNS) and Sections 3(1)(r) and 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

In his bail plea, Dr. Ram has stated that the crime was registered on the basis of the College Principal's statement that Nithin had committed suicide and that there is no mention about any harassment or torture suffered by the deceased.

It is further stated that Nithin's father filed a complaint on the basis of hearsay information and that there is no motive pointed in the complaint as to why he had harassed the deceased student.

He has also stated that he strongly apprehends that the complaint was filed on the basis of instructions from some other persons who wanted to save themselves. He points out that he belongs to a backward community and hails from another State and that is why he was "tortured by an organized group to extract money from him as compensation".

Dr. Ram further contends that Nithin was involved in a honey trap case as well as a loan app issue, and the police, instead of making an investigation in that route, is blindly proceeding against him. He has also submitted that there is no suicide note or any allegation of harassment made by any students against him.

"The Sessions Court was also carried away by the media propaganda than the materials contained in the case diary. A Forensic Analysis of the materials collected by the investigating agency would give an indication that the reason for suicide is not any harassment from the side of the petitioner," he has added.

The application is moved by Advocates S. Rajeev, V. Vinay, M.S. Aneer, Anilkumar C.R., Sarath K.P., Dipa V., K.S. Kiran Krishnan, Akash Cherian Thomas, Azad Sunil, T.P. Aravind, Maheswar Padickal, Akshara S. and Nivedita Rajeev.
