The Kerala High Court recently directed the Commissioner for Entrance Examinations to consider the case of a student who had qualified the National Eligibility Cum Entrance Test (UG)-2023 (NEET), but whose name was not included in the final category list of KEAM-2023 on the ground that she did not upload her NEET (UG) Scorecard.

Justice P.V. Kunhikrishnan directed the said authority to pass appropriate orders in the case within a period of one week.

The petitioner averred that she had duly submitted mandatory documents and other documents such as the Nativity Certificate, CBSE marks statement Cum Certificate, Minority Certificate, Non-creamy layer certificate, Income Certificate, Aadhaar Card, and so on. She submitted that although she had completed all the formalities in the prospectus issued by the Commissioner for Entrance Examinations for admission to professional degree courses, her name was not included in the final category list.

She averred that it was on enquiry that she came to know that the same was since she did not submit the NEET Scorecard. However, the petitioner stated that the prospectus had not mentioned the submission of the scorecard.

"The 3rd respondent (Commissioner for Entrance Examinations) ought to have mentioned the details regarding the submission of the NEET scorecard to the 3rd respondent to KEAM-2023, in Exhibit P3 prospectus itself. Therefore, in the above circumstances, the petitioner is not aware of the submission of the NEET scorecard to the 3rd respondent. In the above circumstances, the non-stipulation of submission of the NEET scorecard in Exhibit P3 prospectus illegal, unfair, bad, unreasonable and to be interfered with by this Honourable Court," the petitioner had averred.

She was aggrieved that despite her having submitted a request in this regard to the Commissioner for Entrance Examinations, the same was not considered.

"If the petitioner is not permitted to submit Exhibit P1 scorecard and not included the existing rank list published by the 3rd respondent the petitioner will lose one year and adversely affect the future of the petitioner and also cause irreparable damage and injury," the plea further stated.

It is in this backdrop that the Court asked the authority to consider the request. Deputy Solicitor General of India S. Manu and Government Pleader P.G. Pramod appeared for State.

The petitioner was represented by Advocate Jestin Mathew
