The Kerala High Court on Tuesday (December 30) granted bail to assistant director Midhil Babu, who is accused of sexually harassing an aspiring young actress in the office of Wayfarer Films Pvt. Ltd., Dulquer Salmaan's production company.
Justice Jobin Sebastian passed the order granting him bail today. A detailed order is awaited.
It was orally observed:
"Petition is allowed...You have to surrender the passport."
His earlier anticipatory bail application was dismissed by the Court last month on November 29 after observing that the investigation was the preliminary stage and that custodial interrogation was necessary.
Subsequently, he was arrested on 3rd December, following which he came before the Court again seeking regular bail.
The prosecution allegation is that Babu called the de facto complainant into the office of the Wayfarer Films Pvt. Ltd. at Panampilly Nagar on the pretext of discussing the story of a film starring Dulquer Salmaan and that when she came into the office, he wrongfully restrained her and outraged her modesty by touching her breast.
He is alleged to have committed the offences punishable under Sections 74 [outraging the modesty of a woman], 75(1) [physical contact and advances involving unwelcome and explicit sexual overtures], 126(2) [wrongful restraint] of Bharatiya Nyaya Sanhita.
In his bail plea, Babu has stated that he is falsely implicated in the case in an attempt to extort money from him through blackmail. It is further stated that he has been in the film industry for 24 years and there has not been any complaint against him yet.
