[Veterinary Student Death] Deceased's Father Moves Kerala High Court Seeking Direction For CBI Probe Based On Govt Order

Jayaprakash T, father of deceased Sidharthan J S, second year Bachelor of Veterinary Science and Animal Husbandry student at the College of Veterinary and Animal Sciences, Pookode in Wayanad district moves the Kerala High Court seeking a direction from the Union Government to entrust the investigation with the CBI based on a government order issued by the State Government. The plea was filed alleging delay on the part of the State Government in forwarding the essential documents to the Union Government for taking further action for entrusting the investigation with the CBI. It is alleged that Sidharthan committed suicide on February 18, 2024, in the hostel room of his college because of ragging and brutal assault from a group of students in the college. The plea stated that Sidharthan was facing assault for more than a period of eight months and he was denied even food and water continuously on days before his death. As per the plea, initially, FIR was registered for unnatural death at the Vythiri Police Station and later additional offences including abetment of suicide, criminal conspiracy and provisions under the Kerala Prohibition of Ragging Act were added. The plea stated that due to the lack of faith in the investigation conducted by the police, the petitioner and his wife submitted a representation before Chief Minister, Pinarayi Vijayan demanding an independent investigation. As per the plea, the Chief Minister had given assurance that the investigation would be entrusted with the CBI. The Additional Chief Secretary had passed an order dated March 09, 2024, entrusting the investigation to the CBI as per Section 6 of the Delhi Special Police Establishment Act. However, the plea stated that the CBI investigation was delayed due to the delay on the part of the State Government in forwarding essential documents to the Union Government. The plea further alleged that the petitioner was informed by the Department of Home Affairs that a minimum period of two months would be taken to forward the essential documents to the Union Government. The petitioner alleges that he is in a pathetic situation and that had believed the dishonest assurances given by the State Government that they would entrust the investigation with the CBI. The plea also alleges that the documents were not forwarded to the Union Government for delaying and avoiding the CBI investigation.The matter will be heard tomorrow by Justice Bechu Kurian Thomas.
